Site Readiness preview terms
Version 1 · 27 October 2026
In short. The preview is free, by invitation, and for a limited time, so that you can try the service and tell us what you think. Its answers come from public roadworks, closures and flood data that can be late or wrong, so check before you act on them. Send us job references, locations, times and the kind of work, and nothing that names or contacts a person. We keep what you send confidential and delete it 90 days after the preview ends, unless your company carries on with us. These terms are the agreement; the summary is not.
1. Who we are and what these terms cover
1.1 The Site Readiness Service is provided by Thri5 Project Consulting Ltd, trading as ThriveFSM, a company registered in England and Wales with company number 11188445, whose registered office is Ground Floor Dearing House, 1 Young Street, Broomhall, Sheffield S1 4UP ("we", "us").
1.2 These terms apply to the preview of the Site Readiness Service: the planning screen, the ability to check job lists and single sites, the decisions you record, and anything else we make available to you during the preview (together, "the preview").
1.3 The agreement is between us and the organisation you work for ("your company"). When you accept these terms you confirm that you are accepting them for your company and that you are allowed to. If you are not, please do not use the preview, and tell us so that we can invite the right person.
1.4 The preview is for businesses only. It is not offered to consumers, and by accepting you confirm that you are using it for your company's business.
1.5 You accept these terms when you first sign in to the preview and confirm that you accept them. We record the version you accepted and when. Our privacy notice explains what we do with personal information; it is information rather than part of this agreement.
2. The preview
2.1 The preview is free of charge. We will not ask your company for payment details during it, and nothing in it commits your company to buy anything.
2.2 It is by invitation only. It runs until the end date we give you, normally 14 days after we set it up, and ends at 03:00 UK time the morning after that date. It includes up to 1,000 checks, where a check is one job at one site in one time slot; the same job checked again on the same day is not counted twice. We may extend either at our discretion. Once the checks are used up, new checks stop at 03:00 UK time the next morning unless we extend, so a day's work is never cut off part way through; anything already on your screen stays there.
2.3 The purpose of the preview is to let your company try the service and to hear what you think of it. It is not a pilot, a trial of a paid plan, or a commitment by us to provide the service later, at any price or at all.
2.4 The service is under active development. We may change, add or remove features, change limits, or pause the preview for maintenance, without notice. We do not promise any level of availability, speed or support during the preview, although we will try to answer questions promptly.
3. Signing in and keeping access safe
3.1 Only the people we invite at your company may use the preview. Each person signs in as themselves, with a code emailed to them each time; please do not share a sign-in or let anyone else use your session.
3.2 Your invitation link lasts seven days and works only for the address it was sent to, so passing it on gives nobody else a way in. If someone else at your company would like to join, ask us and we will invite them.
3.3 Keep your means of signing in secure, and tell us straight away at tom@thri5.co.uk if you think someone else has used your sign-in or your company's access.
3.4 We may remove a person's access at your company's request, and we will do so when told that they have left.
4. What you may and may not do
4.1 You may use the preview to evaluate the service for your company's own business, including checking your company's real planned work.
4.2 You must not, and must not let anyone else:
- give access to the preview, or pass on its answers in bulk, to anyone outside your company, other than contractors working on your company's jobs who need an answer for a job;
- copy, scrape, download in bulk or systematically extract the roadworks, closures and other data behind the answers, or use the preview to build or improve a competing product or dataset;
- try to get round the preview's limits, or send traffic designed to overload it;
- reverse engineer the service, except where the law allows this despite an agreement saying otherwise;
- test, scan or probe the service's security without our written agreement first;
- upload anything containing malicious code, or anything you do not have the right to give us;
- use the preview for anything unlawful.
4.3 If you find what looks like a security problem, please tell us at tom@thri5.co.uk. We will be grateful, and we will not treat reporting it in good faith as a breach of clause 4.2.
5. The job data you give us
5.1 To check a job, the planning screen sends us its reference, its location, its date and times, and the kind of work. When you open a job list on the planning screen, the file itself stays in your browser: columns such as customer and notes are shown on your screen but are not sent to us.
5.2 You will also type some things that are sent to us: the reason you give for a decision, what was found on site (clear, obstructed or not known), and any feedback.
5.3 Please do not give us anything that identifies a person or lets someone contact them. In particular, do not put into references, reasons, notes or feedback any customer's name, phone number or email address, a full property address, an engineer's name, or anything about a person's health or vulnerability, such as a Priority Services Register flag. Give each job's location as a latitude and longitude rather than an address.
5.4 If your company would need to send us any of the information in clause 5.3 to use the service properly, please talk to us before sending it, so that we can agree the right terms first.
5.5 These terms do not cover sending us an export of past visits for analysis. That needs our separate data handling agreement, signed before any file is sent.
5.6 Your company keeps all its rights in its job data and in the decisions and reasons it records (together, "your data"). Feedback is covered by clause 8, and the details of the people at your company who use the preview by our privacy notice. Your company allows us to use your data to provide the preview to your company, to keep it secure, to fix problems with it, and to deal with any questions about how it was used. We may also use your checks, decisions and what was found on site to measure and improve how accurate the service is. Anything we publish or share from that is combined with other information so that it identifies neither your company, nor your jobs, nor any of your locations. We will not sell your data, or use it to provide the service to anyone else.
5.7 Where, despite clause 5.3, your data includes personal data, the Schedule to these terms applies to it.
6. The answers: check before you act
6.1 The service answers whether a site looks ready for work at a given time, based on information published by others: street works permits and restrictions from the Department for Transport's Street Manager service, road and lane closures from National Highways, and flood warnings from the Environment Agency, among others.
6.2 That information can be incomplete, late, inaccurate or withdrawn without notice. Emergency and urgent works may start before anything is published, and some works are never published. We match it to your jobs by rules that are still being developed. So an answer is a guide to help you plan, not a statement of the conditions on site.
6.3 Before acting on an answer, including sending someone to a site or deciding not to, check it in the way your company's own procedures require. The preview does not replace your company's planning, safety or permitting processes, or any obligation your company has under street works or health and safety law.
7. Credits and other people's data
7.1 The answers include information that we use under licences from its publishers, among them the Open Government Licence and National Highways' licence for its Transport Data Feeds. Those licences require the credits shown with an answer, for example "Contains public sector information licensed under the Open Government Licence v3.0" and "Powered by National Highways' Transport Data Feeds".
7.2 If you copy, export or pass on an answer, keep its credits with it. Map data is © OpenStreetMap contributors and must be credited in the same way wherever a map from the preview is shown.
7.3 The publishers provide their information without any warranty, and so do we (clause 10).
8. Feedback
8.1 We would like to hear what you think, good and bad, through the button on the planning screen or by email. Your company allows us to use any feedback for any purpose, including improving the service, without payment or any other obligation.
8.2 We will not quote you, or name you or your company, in anything public or in our marketing without your written agreement.
9. Confidentiality
9.1 The preview itself is confidential to us: the screens, how the service behaves, anything we tell you about our plans or prices, and anything else we mark or describe as confidential. Please use it only to evaluate the service, and do not share it outside your company without our agreement.
9.2 Your data is confidential to your company. We will keep it confidential, use it only as clause 5.6 allows, and share it only with the suppliers who help us run the service, under a duty of confidence, as our privacy notice lists. Your browser also fetches map images and postcode look-ups directly from the public services our privacy notice names; they can see the area being viewed and any postcode searched, and owe no duty of confidence to either of us.
9.3 This clause does not apply to information that is or becomes public other than through a breach of it, that the recipient already had or developed independently, or that the law, a regulator or a court requires to be disclosed, in which case the recipient will tell the other side first where the law allows.
10. No charge, and no promises
10.1 Because the preview is free and under development, it is provided as it is and as available. To the extent the law allows, we give no warranty or undertaking about it, including that it will be accurate, complete, uninterrupted, free of errors or suitable for any purpose, and all terms that might otherwise be implied are excluded.
11. Liability
11.1 Nothing in these terms limits or excludes anyone's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.
11.2 Subject to clause 11.1, we are not liable, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for: any loss of profit, revenue, business, contracts, savings or goodwill; any loss or corruption of data; the cost of any visit that was wasted, aborted or not made; or any indirect or consequential loss.
11.3 Subject to clause 11.1, our total liability arising out of or in connection with the preview is limited to £100.
11.4 The limits in this clause reflect that the preview is free, that its answers come from third-party information, and that your company checks them before acting on them.
12. Ending the preview
12.1 The preview ends at the time in clause 2.2, or earlier if either side tells the other it wants to end it, which either may do at any time.
12.2 We may suspend or end access for a person or for your company straight away if we reasonably believe these terms have been broken, or that continuing would put the service, its data or other users at risk.
12.3 When the preview ends, sign-in to the preview closes and no new checks can be run. If your company chooses to carry on with us, its people, settings and decisions carry on under the terms that then apply. If it does not, we will send your company a copy of the decisions its people recorded on request. We delete your data, and the details of the people at your company who used the preview, 90 days after the preview ends, or sooner if your company asks, except the record of who accepted these terms and our correspondence, which we keep as our privacy notice says. The planning screen's view of a check is kept only in the browser tab that ran it, so download it before closing it; the answers themselves are kept with your data and deleted with it. Deleted data leaves our backups and our test copy of the service within 14 days.
12.4 Clauses 5.6 (as to anything already combined so that it identifies nobody), 7, 8, 9, 11, 12.3 and 14 continue after the preview ends.
13. Changes to these terms
13.1 We may publish new versions of these terms. A new version applies only once it has been accepted at sign-in, and we keep a record of which version each person accepted.
14. General
14.1 These terms are the whole agreement between your company and us about the preview, and replace anything said or written before about it. Neither side has relied on anything not set out in them. Nothing in this clause limits liability for fraud.
14.2 Nothing in these terms creates a partnership, joint venture or agency. Neither side may transfer its rights under them without the other's agreement, except that we may transfer them to a business that takes over the service.
14.3 Only your company and we have rights under these terms. The Contracts (Rights of Third Parties) Act 1999 does not apply.
14.4 If a court finds part of these terms unenforceable, the rest remains in force. Not enforcing a right straight away does not mean giving it up.
14.5 Notices under these terms may be sent by email: to us at tom@thri5.co.uk, and to your company at the address of the person who accepted these terms or another address your company gives us.
14.6 These terms, and any dispute or claim arising out of or in connection with them or the preview, including non-contractual ones, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
Schedule: if your data includes personal data
S.1 This Schedule applies only to personal data that is in your data despite clause 5.3. For that personal data, your company is the controller and we are its processor, and this Schedule is the contract required by Article 28 of the UK GDPR. It does not cover the details of your company's people who use the preview, including their names, email addresses, sign-in records and which decisions they made, or feedback: we handle those as controller, as our privacy notice explains.
S.2 The particulars. Subject matter: checking your company's jobs against roadworks, closures and other published constraints, and recording the decisions taken. Duration: the preview, and the period until deletion in clause 12.3. Nature and purpose: storing, matching, displaying and deleting the data, to provide the preview to your company. Types of personal data: whatever personal data is included in job references, locations and the reasons given for decisions, contrary to clause 5.3. Data subjects: your company's customers and other people at or connected with the sites of its jobs, and anyone else named in job data.
S.3 We will:
- process the personal data only on your company's documented instructions, which are these terms and your company's use of the preview, unless the law requires otherwise, in which case we will tell your company first unless the law forbids it, and tell your company if we think an instruction breaks data protection law;
- make sure that anyone we allow to process it is under a duty of confidence;
- keep it secure with appropriate technical and organisational measures, as Article 32 of the UK GDPR requires, including encryption in transit and at rest, access limited to those who need it, multi-factor sign-in for our administration, and a log of administrative actions that cannot be altered, only deleted at the end of the retention period;
- use the suppliers listed in our privacy notice as sub-processors, which your company authorises, on terms that protect the data in the same way; tell your company before adding or replacing one, so that it can object, and if it does and we cannot resolve the objection, it may end the preview at once; and remain responsible for what they do;
- transfer it outside the UK only with the safeguards UK data protection law requires;
- help your company, as far as we reasonably can, to respond to people exercising their rights, and to meet its obligations on security, breach notification, data protection impact assessments and consulting the regulator;
- tell your company without undue delay, and in any case within 48 hours, after becoming aware of a personal data breach affecting it, with the information your company needs to meet its own obligations;
- delete it at the end in the way clause 12.3 describes, unless the law requires us to keep it, or return it first if your company asks before then;
- give your company the information it reasonably needs to show that this Schedule is being met, and allow and contribute to audits, including inspections, by your company or an auditor it appoints, on reasonable notice and at your company's cost.
S.4 Your company is responsible for having a lawful basis for any personal data it gives us, and for telling the people concerned.
